The much awaited rules under the Digital Personal Data Protection Act, are set to be a reality. The draft rules have been approved by the Home Ministry, and MeitY is set to release it for public consultation.
The Rules will address issues such as consent mechanisms, data handling procedures, and compliance timelines. Upon implementation, the Act will empower consumers with greater control over their data, including the right to demand details on the purpose of the data collection, and deletion of the data. Penalties for data breaches can range from upto Rs. 10,000 to upto Rs. 2.5 billion depending upon the nature of breach.
The transition period for companies to adapt to the new framework is likely to be 18 to 24 months.
