Insights on Legal Issue in Infrastructure: Panel Discussion at India Infrastructure Forum 2023


We are delighted to share that Mr Abhishek Kumar, Partner at Singhania & Partners LLP, was a distinguished speaker at the panel discussion on "Legal Issues in Infrastructure" during the India Infrastructure Forum held on May 10 and 11, 2023, at Taj Palace in New Delhi, India.

 

The panel discussion included esteemed panelists Mr V. Lakshmikumaran, Founder and Managing Partner at Lakshmikumaran & Sridharan, Mr Anjan Dasgupta, Partner at DSK Legal, and Ms Pallavi Bedi, Partner at Phoenix Legal. Their extensive expertise and insights further enriched the discussion, providing diverse perspectives on the legal challenges in infrastructure projects.

 

Mr Kumar’s insightful session focused on the critical legal issues that hinder infrastructure projects, especially projects on PPP basis, such as delay in taking crucial decisions, delay in granting extension of time, not releasing annuities/ payments on time, not following the contracts in their true spirit besides other important issues which arise in various Infrastructure arbitrations. He provided valuable solutions such as revisiting the restrictive clauses in infrastructure contracts, timely actions from the various statutory authorities etc., which can help in removing hurdles in various Infrastructure projects.

 

Additionally, Mr Kumar highlighted the recent Supreme Court judgment on the stamping of arbitration agreements and the powers of arbitral tribunal to decide the voidability of contractual clauses. He also shared his concerns regarding the practical implications of such decisions.

 

The audience greatly appreciated Mr Kumar's expertise in navigating the legal complexities of infrastructure projects.
